Terms & Conditions | Kinetiq Performance Group
Last updated: October 2026
1. Who we are and scope of these terms
These Terms govern your use of the Kinetiq OS platform and this website, operated by Kinetiq Performance Group, established in the Netherlands (company details as published in the website footer). By creating an account, subscribing, or using the platform you accept these Terms. If you use the platform on behalf of a club or organisation, you confirm you are authorised to bind that organisation, and that organisation is also bound by these Terms.
2. Description of the service
Kinetiq OS is a sports performance operations platform for clubs, academies and coaches: availability and squad management, wellness check-ins, training load tracking, injury and return-to-play workflow management, calendar and communication tools, and optional wearable data integrations. It is a management and record-keeping tool.
3. Not medical advice; distinction from healthcare
Kinetiq OS is NOT a healthcare or physiotherapy service and does not provide medical diagnosis, treatment, or clinical advice. Return-to-play plans and clinical records in the platform are managed by your club's own qualified staff, who remain responsible for all professional and clinical decisions. Nothing in the platform constitutes medical advice; always consult an appropriately qualified healthcare professional for medical concerns. Kinetiq does not present itself as a licensed physiotherapy provider unless such services are separately and explicitly agreed in writing and delivered by appropriately qualified professionals.
4. Accounts, eligibility and minors
You must provide accurate account information and keep credentials confidential; you are responsible for all activity under your account. Staff accounts require an invitation from a club administrator. The platform is intended for users aged 16 or older; accounts for younger athletes may only be created and managed by their club, and where required by law a parent or guardian must provide consent through the guardian flow. Clubs are responsible for the accuracy and lawfulness of the athlete data they enter.
5. Club responsibilities and athlete data
Where a club enters or manages personal data about its athletes, the club acts as controller of that data for its own purposes and Kinetiq processes it on the club's documented instructions as part of providing the service. Clubs warrant they have a lawful basis (including any required guardian consent) for the data they enter, and will use the platform's access controls to protect athlete health data.
6. Subscriptions, billing and VAT
Paid plans are billed in advance on a recurring per-team basis, in the currency shown at checkout. Prices shown at checkout include applicable VAT unless stated otherwise, and any one-off or setup fees will be shown before you pay. Subscriptions renew automatically until cancelled. You may cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period, and you retain access until then. See our Refund Policy for refund conditions.
7. Consumer right of withdrawal
If you conclude a distance contract with us as a consumer in the EU, you generally have the right to withdraw within 14 days without giving a reason. Where you expressly request immediate access to digital content (the platform) during the withdrawal period, you acknowledge that access begins immediately and that, once the service is fully delivered at your request, you lose the withdrawal right for it. This right applies as required by mandatory EU and Dutch consumer law; nothing in these Terms limits it.
8. Acceptable use
You agree not to: misuse the platform or attempt to access data of other clubs or athletes you are not authorised to see; upload unlawful content, including content violating athlete privacy; reverse-engineer, scrape or resell the service; or interfere with its security features. We may suspend accounts that breach these rules, after notice where practicable.
9. Intellectual property
All content, features and functionality of the platform — including text, graphics, logos and software — are owned by Kinetiq Performance Group or its licensors and are protected by intellectual property law. You receive a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose during your subscription. You retain all rights to your own data and content entered into the platform.
10. Availability and service changes
We aim for high availability but do not guarantee uninterrupted or error-free service. We may modify or discontinue non-core features with reasonable notice. Planned maintenance will where possible be communicated in advance.
11. Limitation of liability
To the maximum extent permitted by law, Kinetiq Performance Group is not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from use of the platform. Our total aggregate liability is limited to the subscription fees paid by you in the 12 months preceding the claim. These limitations do not apply to liability that cannot be excluded under mandatory law, including liability for intent, deliberate recklessness, or death or personal injury caused by negligence.
12. Termination
You may stop using the platform and cancel your subscription at any time. We may terminate or suspend your account for material breach of these Terms (with notice and a cure period where practicable) or where required by law. On termination you can export your data during a reasonable wind-down period, after which it is deleted or anonymised in line with our Privacy Policy.
13. Governing law and disputes
These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in the Netherlands, except that consumers may also bring proceedings in their country of residence and rely on mandatory consumer protections of that country.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the platform or by email at least 14 days before they take effect; continued use after that date constitutes acceptance. If you do not agree, you may cancel before the changes take effect.
